By creating an account and using My Truck ("the App"), you agree to the following terms. If you do not agree, do not create an account or use the App.
1. License to Use
My Truck grants you a limited, non-exclusive, non-transferable license to use the App for your personal or business record-keeping purposes, subject to these terms.
2. The App Is a Tool, Not a Guarantee
My Truck is a tracking and reporting tool only. It is provided to help you organize and estimate information you supply. It does not replace your own recordkeeping obligations, your employer's or carrier's requirements, or any regulatory, tax, or legal recordkeeping standard. You are solely responsible for verifying the accuracy of any data, calculation, or report the App produces before relying on it for any purpose.
3. No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR SUITABLE FOR YOUR SPECIFIC NEEDS.
4. Assumption of Risk / Limitation of Liability
YOU ASSUME ALL RISK AND RESPONSIBILITY FOR YOUR USE OF THE APP. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY TRUCK AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE APP — INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, MISSED FUEL BONUSES OR GOALS, COMPLIANCE ISSUES, OR ANY DECISION MADE BASED ON APP OUTPUT — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
5. Data Security
We take reasonable, industry-standard measures to protect your account data (including encrypted storage of credentials and secure transmission). No system can be guaranteed 100% secure, and we cannot guarantee against all possible unauthorized access. You are responsible for keeping your login credentials confidential.
6. Your Responsibilities
You agree to provide accurate information, keep your credentials secure, and use the App only for lawful purposes. You are responsible for all activity under your account.
7. Changes to the App or These Terms
We may update the App or this Agreement at any time. Continued use after an update constitutes acceptance of the revised terms. Material changes will require re-acceptance at your next login.
8. Termination
We may suspend or terminate your account at our discretion, including for violation of these terms.
9. Entire Agreement
This Agreement is the entire agreement between you and My Truck regarding use of the App and supersedes any prior understanding. This Agreement does not create a partnership, joint venture, or agency relationship between you and My Truck.
